By accessing or using ClawdMail ("the Service") at clawdmail.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time; continued use after changes constitutes acceptance of the revised terms.

2. Description of Service

ClawdMail is an agentic email marketing platform that provides AI-powered email creation, sending, and analytics. The Service enables you to build and manage subscriber lists, create and send marketing campaigns, and access analytics and reporting. Features and functionality may be updated or changed over time.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it updated. You agree to:

  • Use the Service only for lawful purposes
  • Ensure all data you provide or upload is accurate and compliant with applicable laws
  • Notify us immediately of any unauthorized access to your account

4. Acceptable Use

You must not use the Service to send spam or unsolicited commercial email. You represent that you have obtained appropriate consent from all recipients before adding them to your lists and sending marketing communications. You must comply with:

  • CAN-SPAM Act and other applicable anti-spam laws
  • GDPR and other data protection regulations where applicable
  • Industry best practices for email marketing

Prohibited uses include: sending unlawful, harassing, or deceptive content; distributing malware; harvesting email addresses without consent; or using the Service in any way that could harm the platform or other users.

5. API Usage Terms

If you use our API to integrate with the Service, you must comply with any applicable API documentation, rate limits, and usage guidelines. We may modify or discontinue API access with reasonable notice. Abuse of the API, including excessive requests or use that impacts system performance, may result in suspension or termination of access.

6. Intellectual Property

You retain all rights to the content you create, upload, or transmit through the Service, including subscriber data and email content. ClawdMail owns all rights to the platform, software, trademarks, and any materials provided by us. By using the Service, you grant us a limited license to use, store, and process your content solely for the purpose of providing the Service to you.

7. Data Handling

Our collection, use, and protection of your data is described in our Privacy Policy. By using the Service, you acknowledge that you have read and agree to the Privacy Policy. You are responsible for ensuring that your use of the Service and any data you provide complies with applicable data protection laws.

8. Service Availability and Limitations

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service is provided "as is" and we may modify, suspend, or discontinue features with reasonable notice. We are not responsible for delays or failures caused by factors outside our control, including third-party services, network issues, or force majeure events.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAWDMAIL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms. If you do not agree to the new terms, you must stop using the Service.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or the Service shall be resolved in accordance with applicable federal and state law.
